SHC summons Mujeeb, Zaman on 25th The Dawn - 19 August 1999 Hyderabad, Aug 18: A Division Bench of the Sindh High Court, Hyderabad circuit Bench, here on Wednesday has issued notices to Pakistan Cricket Board (PCB) ad hoc committee chairman Mujeeb-ur-Rehman and member Javed Zaman for Aug 25. The notices were issued on a constitutional petition, filed by Hyderabad Division Cricket Association (HDCA), challenging its suspension. Another application was also filed along with the petition, praying for an interim injunction against the respondent to retrain the respondents from suspending HDCA and freezing its accounts and sealing its office at Niaz Stadium. The petition was filed by advocate Allah Bachayo Soomro. The lawyer contended that office-bearers of the suspended HDCA were elected in last elections held in 1994 and that on July 17, 1999 President of Pakistan had suspended management of the PCB by invoking clause 1 of article 41 of constitution of PCB and had appointed an ad hoc committee consisting of respondents to run the board's affairs. The counsel contended that the chairman and member ad hoc body interfered in the affairs of cricket associations, suspending them all over the country and this came to known only through newspapers because no notice, whatsoever, had been issued to HDCA to-date. Claiming that HDCA's account had also been frozen, he pleaded that after his client's suspension there was complete chaos and confusion among 120 cricket clubs enrolled with HDCA. He informed the court that the suspended association had already finalized arrangements for Under-19 tournament which was about to be commenced and various requirements are still to be fulfilled. But under the existing circumstances not only the petitioner but cricket clubs would be adversely affected. He argued that respondents were not authorized to suspend management of the petitioner, appoint any sub-committee and freeze bank accounts as these actions were malafide, void and illegal. Quoting certain articles of PCB constitution, he prayed the court to declare that respondent's action was illegal and of no legal effect. He prayed the court to restrain the respondents from suspending the HDCA and interfering in its affairs.
