WIN WITH GM 2001 TERMS AND CONDITIONS

1. ELIGIBILITY AND ENTRY

1.1 This Competition is not open to any person who is an employee or agent of the Organiser or any of its group companies or any Dealer or professional adviser or any one else professionally connected with this Competition or to the immediate family of any such person.

1.2 Entry Forms for Entrants who are under 18 on 1st December 2000 must be countersigned by the Entrant's parent or guardian.

1.3 As a condition of entry to this Competition the Entrant (and in the case of those Entrants under 18 his/her parent/guardian on his/her behalf) will be deemed to have read and understood these Terms and Conditions and be bound by them.

1.4 To be eligible for this Competition the Entrant must:

1.4.1 have purchased a Bat from a Dealer or had one purchased on his behalf on or after 1st December 2000; and

1.4.2 ensure that the completed Entry Form is stamped by the Dealer, and posted to be received by the Organiser;

(a) by 1st June 2001 in respect of the highest Average prize (pursuant to clause 2.1 below); and/or

(b) prior to the inning for which such prize is claimed in respect of the highest Individual Score prize (pursuant to clauses 2.2, 2.3, 2.4 and 2.5 below); and

1.4.3 complete the Entry Form in accordance with these Terms and Conditions; and.

1.4.4 not at 1st December 2000 be classified as a Professional; and

1.4.5 use the Bat in each Innings or provide an explanation satisfactory to the Organiser why the Bat has not been used in each Innings; and

1.4.6 play in an Approved League.

1.5 No entry which is not on the Entry Form will be valid and registration shall not be confirmed until the Entry Form has been received by the Organiser. Failure to comply with each of the criteria set out in clause 1.4 shall result in the Entrant being disqualified.

1.6 Proof of posting the Entry Form will not be deemed to be proof of delivery.

1.7 Subject to clause 1.4.2(a) any Innings played prior to 1 June 2001 will be regarded as valid for the purposes of this Competition in relation to the highest Average prize.

1.8 For the purposes of all prizes other than the highest Average prize, no Innings played prior to receipt of the Entry Form by the Organiser will be regarded as valid for the purpose of this competition in respect of such other prizes.

1.9 Any Entry Form which is damaged, defaced, illegible, incomplete, or which does not otherwise comply with these Terms and Conditions may be deemed to be invalid in the sole discretion of the Organiser.

1.10 Notwithstanding clause 1.4.2, if the Entrant purchases a Bat by mail order from a Dealer and the Entry Form is not stamped by Dealer, the Organiser may at its sole discretion accept satisfactory proof of purchase as an alternative to the requirement to sending a stamped Entry Form provided that the Entry Form sent is valid, complete and satisfies these Terms and Conditions in all other respects.

2. PRIZES

2.1 The Organiser shall award one cash prize of £100,000 to the Entrant with the highest Average in League Matches over the course of the entire Approved League season provided that, for the avoidance of doubt, should the cricketer with the highest Average throughout the Approved Leagues not be eligible for this Competition, no such prize shall be awarded.

2.2 The Organiser shall award one cash prize of £2,500 to the Senior with the highest Individual Score in a single Innings in any one League Match.

2.3 The Organiser shall award one cash prize of £500 to each Senior with the highest Individual Scores in each of the batting order positions, as set out in the Entry Form. A Senior is welcome to claim a prize in relation to a batting order position other than that shown on his Entry Form, but in such circumstances the Organiser may require corroborating evidence that such change was as a result of sound cricketing reasons as a pre-condition of awarding such prize.

2.4 The Organiser shall award one cash prize of £500 to the Junior with the highest Individual Score in one Junior Match together with the opportunity to receive a Gunn and Moore three year sponsorship contract (subject to terms and conditions).

2.5 The Organiser shall award one prize of Gunn and Moore cricket equipment up to a value of £500 to each of the Juniors with the highest Individual Scores in one Junior Match in each of the batting order positions as set out in the Entry Form. A Junior is welcome to claim a prize in relation to a batting order position other than that shown on his Entry Form, but in such circumstances the Organiser may require corroborating evidence that such change was as a result of sound cricketing reasons as a pre-condition of awarding such prize.

2.6 To be eligible for the highest Average prize the Entrant must be dismissed in no fewer than five Innings for the same team of any one club in League Matches (other than Junior Matches) in an Approved League.

2.7 For the avoidance of doubt, those non-cash prizes detailed at 2.5 shall be selected by the winners from a selection of Gunn and Moore equipment as decided by the Organisers and the value of such non-cash prizes shall be by reference to the Gunn and Moore suggested retail prices as at the date on which the prizes are provided to the winners.

2.8 Notwithstanding that the winner of the Competition may have been declared, if the Organiser discovers before the delivery of any prize that for any reason under these Terms and Conditions the winner should not have been eligible to enter the Competition or if the entry should have been declared invalid, the Organiser reserves the right to determine that the winner is disqualified and no prize shall be awarded to such Entrant.

2.9 In relation to any of the prizes described above the Organiser shall be entitled to withhold payment or require reimbursement of any prize which it reasonably believes was not won strictly in accordance with these Terms and Conditions or was won as a result of collusion or arrangements not consistent with the proper playing of the game of cricket or if the claimant is found to be ineligible or ought to have been disqualified under these Terms and Conditions.

3. COMPETITION RULES

3.1 In the event that 2 (two) or more Entrants have identical Averages the following criteria will be applied in the following order to find the winner of the highest Average prize:

3.1.1 The player with the highest Aggregate followed by;

3.1.2 The highest Individual Score, "not outs" taking precedence, followed by;

3.1.3 The second highest Individual Score, "not outs" taking precedence, followed by;

3.1.4 The third highest Individual Score, "not outs" taking precedence, followed by;

3.1.5 The fourth highest Individual Score, "not outs" taking precedence, followed by;

3.1.6 The fifth highest Individual Score "not outs" taking precedence; In the event that, following operation of clauses 3.1.1 to 3.1.6 two or more Entrants remain tied, the highest Average prize will be shared equally between them.

3.2 In the event that two or more Seniors or Juniors (respectively) in any category achieve identical highest Individual Scores, any "not out" score shall take precedence failing which, the following criteria will be applied in the following order to find each winner:

3.2.1 The second highest Individual Score, "not outs" taking precedence, followed by;

3.2.2 The third highest Individual Score, "not outs" taking precedence, followed by;

3.2.3 The fourth highest Individual Score, "not outs" taking precedence, followed by;

3.2.4 The fifth highest Individual Score, "not outs" taking precedence; In the event that, following operation of clauses 3.2.1 to 3.2.4 two or more Seniors or Juniors remain tied, the prize in question will be shared equally between them.

3.3 It is the responsibility of all Entrants who believe they are eligible for a prize to send an Official Claim form to the Organiser to be received by the Organiser by 30th September 2001 with full details of the Innings for which the highest Individual Score prize entry is made, and/or the number of Innings, the Aggregate and Individual Scores for each and every League Match (including completed and "not out" Innings) in respect of the claim for the highest Average prize. All relevant evidence to support the Entrant's claim (including, without limitation the score sheet for the relevant League Match(es) signed by the match official and/or the manager or captain of both teams playing such League Match(es) in accordance with the rules of the Approved League in question) must be received by the Organiser by 15th November 2001. Claims must be made on an official Claim Form available from the Dealer and/or the Organiser. The Organiser reserves the right to invalidate any claim if the Claim Forms or supporting evidence is received by the Organiser after the due dates of receipt as set out in this clause.

3.4 The Organiser reserves the right to inspect all relevant documentation, talk to any relevant third parties and take other reasonable steps to validate claims including, without limitation, engaging a third party claims investigator, and the Entrant and in the case of an Entrant under 18 his/her parent/guardian shall co-operate fully with the Organiser and/or such third party in this respect. Lack of credible supporting evidence will render any claim invalid.

3.5 The Organiser reserves the right to request additional evidence supporting the Entrant's claim as it deems fit.

3.6 The Organiser's name and address is Unicorn Products United of 119/121 Stanstead Road, Forest Hill, London SE23 1HJ.

3.7 Entry Forms must be submitted to the following address: Win With GM 2001, 119/121 Stanstead Road, Forest Hill, London SE23 1HJ.

3.8 The winners will be notified by post on or before 11th January 2002 and the results will be published on or before the same date. The Entrant consents to his/her details being published in the event that he/she wins a prize and agrees to take part in any publicity activities relating to this Competition. All personal data will be used in accordance with the Data Protection Act 1998.

3.9 Prizes shall either, at the election of the Organiser, be dispatched within six weeks of such notification or shall be awarded to the winners at a public presentation within six weeks of notification of the winners at a time and venue to be confirmed. The Organisers will reimburse reasonable travel expenses of the winners for attending any prize giving ceremony.

3.10 The list of winners will be available for four weeks following the six week period described in 3.8 above and can also be obtained by sending an SAE to the Organiser.

3.11 The winner of any prize may not elect to accept a lesser prize except with the consent of the Organiser and the winner of that lesser prize.

3.12 In relation to the prizes of Gunn & Moore cricket equipment, no cash alternative will be made available.

3.13 All decisions of the Organiser's panel of judges will be final and binding on the Entrants and no correspondence will be entered into.

DEFINITIONS AND INTERPRETATION

Approved League

An Approved League will be one that

:i) Takes place wholly within the United Kingdom and/or the Republic of Ireland; and

ii) Publishes a list of its officers, fixtures, constitution and playing conditions by way of a handbook or other medium acceptable to the Organiser; and

iii) Which requires the submission of detailed information on the game signed by an appropriate match official according to its rules printed in its handbook after each League Match; and

iv) Holds and is prepared to make available to the Organisers of this competition sufficient information to confirm the validity of any entry.

Aggregate the total number of runs scored for the same team of any one club in the Approved League season, including "not outs" and completed Innings.
Average the Average is the Aggregate divided by the number of completed Innings in all League Matches for the same team of any one club in an Approved League season. For an Average to be valid the Entrant must have been dismissed on no fewer than 5 (five) occasions. The Average must be calculated on all Innings played by the Entrant in League Matches and may not be calculated on selected Innings only.
Bat a Gunn and Moore English Willow cricket bat;
Dealer any party who is an authorised supplier of Bats and who participates in this promotion;
Entrant any Junior or Senior;
Individual Score the Entrant score in any one Innings in any League Match;
Innings any League Match Innings played by the Entrant;
Junior any person (male or female) under the age of 15 as at 1st September 2000 who is eligible to enter into this Competition and who has been entered into this Competition subject to these Terms and Conditions;
Junior Match a match played in the UK and/or Republic of Ireland by Juniors only that is capable of being validated by a County Development Officer, an officer of a Schools Cricket Association, the headmasters of the schools involved or any other officials subject always to the approval by the Organiser;
League Match a competitive cricket match played and regulated by an Approved League excluding any matches in knock-out competitions or play-offs and excluding any Junior Matches;

Professional

For the purpose of this Competition a Professional is:

i) any player currently registered or contracted to a First Class County as defined by the England and Wales Cricket Board (ECB);

ii) any player who has been registered or contracted to a First Class County as defined by ECB at any time since 1st April 1991;

iii) any player who receives remuneration for playing cricket and that remuneration is the player's main source of income;

iv) any player defined as a professional under the rules of the Approved League in which he/she plays;

v) any overseas player in the possession of a Work Permit to play cricket issued by the Overseas Labour Service;

vi) any player not qualified to play for England under the current ECB regulations, unless he has been permanently resident in the United Kingdom since 1st April 1999 and regarded as a non-overseas player under the Terms and Conditions of the Approved League in which he plays;

vii) any player who has played first class cricket as defined in the ICC regulations in force at 1st December 2000 anywhere in the world since 1st April 1991.

Senior any person (male or female) who is 15 or over on 1st September 2000 who is eligible to enter into this Competition and who has been entered into this Competition subject to these Terms and Conditions;
